The User accepts the established Conditions, as well as their possible modifications, without prejudice to the application of the corresponding legal regulations of obligatory compliance as the case may be.

The User assumes responsibility for the correct use of the website www.oxino.com. This responsibility will extend to:
– Make only legally valid inquiries, purchases or acquisitions.
– Not to make any false or fraudulent purchase.
– Provide truthful and lawful contact details.

PURPOSE

These Conditions regulate the transactions made through the website www.oxino.com which Werku makes available to the User. Purchases on the website www.oxino.com can be made from any country in the world, being the sale made from Spain. The products that Werku sells through its website are mainly technical chemicals.

These Conditions have been prepared in accordance with the provisions of Law 34/2002, of services of the information society and electronic commerce, Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, all of them legal provisions of mandatory application.

Werku may modify these Terms and Conditions without prior notice, so that the User is recommended to periodically consult them, especially when he/she is about to make a purchase. Werku undertakes to always publish the latest update of the Conditions and to allow its access and printing.

The User must register in order to purchase on the website www.oxino.com, having to proceed to the completion of a form, which will involve assigning personal credentials consisting of an email address and a password, whose conservation and custody will depend exclusively on the User. Therefore, the User will not use passwords other than his own, in order to impersonate another User.

 The purchase of a product on the website www.oxino.com can only be made by a User of legal age, who must follow the steps and instructions that will accompany the entire purchase process and which consist, among others, of the following:

1) Completion of the registration form or User identification form previously registered.
2) Visualization on screen of the summary of the order, delivery conditions and shipping costs.
3) Acceptance on the part of the User of the conditions of purchase, which supposes the reading, understanding and irrevocable acceptance of these Conditions, as well as in its case, of the existing particular conditions.
4) Immediate reception by the User of an e-mail confirming and summarizing the order.

ORDERS

The User will not be able to place an order without expressly accepting, through the boxes provided for this purpose, the Werku Conditions. All orders placed will be considered as purchase offers subject to these Werku Conditions.

When a User places an order, and everything is correct, the system automatically generates a receipt of the order. This proof of receipt does not imply the automatic acceptance of the order, since Werku reserves the right to collect additional information, related to the identity and address of the User, to ensure both a correct shipment of the order, as well as to ensure the absence of fraud. In any case, Werku may, at its own discretion, not accept an order if it deems it necessary.

The User may place orders 365 days a year and 24 hours a day, except at times when the website www.oxino.com is suspended for maintenance or any other circumstance of force majeure.

Any order placed by the User is subject to the availability of the product in question. In the event that Werku does not have stock to serve the order in question, the User may cancel the order or wait for its availability.

DELIVERY

Delivery of the purchased product shall be deemed to have occurred at the moment when the User, a third party indicated by the User or a third party representing the User acquires material possession of the purchased product.

The delivery time for the order placed will vary according to the shipping method selected and the destination town. In any case, such delivery time shall not exceed 30 days from the date of order confirmation. In the event that Werku is unable to meet the delivery date, it will inform the User of this circumstance and offer either an alternative or the possibility of cancelling the order with full refund of the amount paid.

In case of failed delivery, the conditions of the carrier, as a third party, will determine the procedure, although Werku will always encourage successive delivery attempts.

PRICE AND PAYMENT

It is understood that the price of each product is the one that will appear on the website www.oxino.com at the time of placing each order. The User must pay the marked price, including applicable taxes, along with any shipping costs, which will be added to the final amount payable.

The prices on the website www.oxino.com may be modified by Werku at any time and without prior notice, without affecting orders already confirmed. However, even for orders already confirmed, Werku shall not be obliged to fulfill such orders when the price is incorrect, especially when the error is obvious and easily recognizable.

Generally speaking, the methods of payment accepted on the website www.oxino.com are as follows:
– Credit or debit card
– PayPal
– Bank transfer

Werku reserves the right to change these payment methods, and may create new ones or eliminate any of the existing ones, without the User being able to make claims for this reason. In the event that the change in the payment method affects an order already confirmed, Werku will contact the User to inform him/her about the change, and the User may cancel the order.

For payments by credit or debit card, the charge is made in real time through the payment gateway of the corresponding financial institution and once it has been verified that the data provided by the User are correct.

In order to provide maximum security to the payment system, the website www.oxino.com uses secure payment systems of leading financial institutions in electronic commerce. In this sense, the confidential data of the User are transmitted directly and in encrypted form (SSL) to the corresponding financial entity. This SSL encryption system confers total security to the transmission of data through the network. The User’s data are completely confidential and protected. The data on credit or debit cards are not registered in any database of Werku and are only used in the virtual POS of the financial institution through its secure payment gateway.

Credit or debit cards are subject to checks and authorizations by the corresponding issuing entity, but if such entity does not authorize the payment, Werku shall not be liable for any delay, non-delivery or order cancellation.

Werku reserves the right to verify the personal data provided by the User and to take the measures it deems appropriate (including the cancellation of the order) so that the purchased goods are delivered in accordance with the data contained in the order.

Regarding PayPal payments, these are made directly on the PayPal website, following the terms of use established by PayPal. In the event that a confirmed order has not been paid within one hour, or that the amount is not correct, Werku may cancel the order.

Regarding payments by bank transfer, the User must make the deposit in the bank account that Werku establishes at that time. In the event that a confirmed order has not been paid within 72 hours, or that the amount is not correct, Werku may cancel the order.

RIGHT OF WITHDRAWAL

The User has the right to cancel a purchase made on the website www.oxino.com within 14 calendar days and without justification. This withdrawal period will expire 14 calendar days after the actual delivery of the product. To exercise the right of withdrawal, the User must notify Werku of his/her decision to withdraw by means of an unequivocal written statement. The User may use the model withdrawal form included as an annex at the end of these Conditions, although its use is not mandatory.

In order to meet the withdrawal deadline, the User’s corresponding letter must have been sent before the expiry of the withdrawal period.

In case of withdrawal, Werku will refund the amount paid by the User, including the transport costs, within 14 calendar days from the date on which the User has informed Werku about the withdrawal. In this case, Werku will proceed to make the corresponding refund by the same means of payment used by the User for the initial transaction, without any cost for the User as a result of the refund. Regardless of the period of 14 calendar days mentioned above, Werku will not make the refund until it has received the product in question in perfect condition. In other words, the User must first return the product in question to Werku, assuming the cost of transporting the returned product, in order for such return to be reimbursed.

 The right of withdrawal shall not apply in the following cases:

– For products whose price depends on market fluctuations.
– For products made and customized according to the User’s specifications.
– For products that may deteriorate or expire rapidly.
– For health protection or hygiene products that have been unsealed after delivery.

WARRANTY

In accordance with the General Law for the Defense of Consumers and Users and other complementary laws,

Werku offers on all its products a warranty of two years from delivery. In the event of an incident, Werku will proceed, at its discretion, to repair, replace, reduce the price or refund the corresponding amount. The User, in case of making a warranty claim, may do so through the means of contact provided above. This warranty does not cover wear and tear caused by use, nor defects caused by improper use.

Werku has a Customer Service Department so that the User can manage claims, doubts, warranty requests and the execution of the right of withdrawal. The User can contact the Customer Service by any of the following means:

Werku will attend to all doubts, complaints and suggestions as quickly as possible, without exceeding in any case the deadlines established in the current legislation.
