COLLECTION OF PERSONAL DATA
The personal data of the User is collected by Werku. Personal data refers to all information referring to an identified or identifiable natural person (affected person). Identifiable is understood to be a person who can be identified: directly or indirectly, especially by reference to a name, an identification number (ID, passport, etc.) or to one or more specific elements, specific to its physical, physiological, genetical, psychical, economic, cultural or social identity.
The personal data that in general will be collected are the following:
– Name and surname
– Phone number
– Date of birth
– Data related to means of payment
– Others, about which the User would be informed
PURPOSE OF PERSONAL DATA PROCESSING
The purpose of the processing of personal data is to improve the relationship between Werku and the User, offer products and services in accordance with the interests of the User, improve the browsing experience of the User and, where appropriate, to process its applications, requests or orders. Werku will prepare a commercial profile of the User with said personal data, but will not make automated decisions based on that profile.
The personal data provided by the User will be kept while maintaining a business relationship with Werku, provided that the User does not request its deletion, or that legal obligations oblige such deletion.
The personal data of the User will be recorded in a client file and its treatment will be recorded in the Werku treatment register. The company Sendinblue will act as the processor of the personal data of the User and Werku as the controller of said data. LEGITIMATION FOR THE PROCESSING OF PERSONAL DATA
The legal basis for the treatment of the personal data of the User is the following:
– The correct execution or fulfillment of the contract
– The legitimate interest of Werku
– The consent of the User for the processing of its personal data
RECIPIENTS TO WHOM THE PERSONAL DATA WILL BE COMMUNICATED
The personal data of the User may be communicated to third parties, related to Werku by contract, to carry out the tasks necessary for the management of the account of the User and without the latter having to give its authorization to do so.
The personal data of the User may be communicated to the competent authorities in the event that the User has taken actions contrary to the Law or breached the content of the Legal Warning.
The personal data of the User may be communicated to other companies within the Werku group, for internal administrative purposes that could involve a processing of such personal data.
The personal data of the user may be transferred to a third country or to an international organization, as long as Werku informs the User about said transmission, its conditions and the recipient.
When some of the personal data of the User is mandatory to access specific functionalities of the website www.oxino.com, Werku will indicate this mandatory nature at the time of personal data collection.
Regarding the personal data of the User, the User has the possibility to exercise its rights of access, rectification, cancellation and opposition. In addition, the User has the right to limit the processing of its personal data, the right to delete the transfer of its personal data transmitted to the person responsible for the treatment and the right to the portability of its personal data.
The User has the possibility to file a claim with the Spanish Data Protection Agency or any other competent body, when he has not obtained a satisfactory solution in the exercise of his rights.
Unless the User has sent a claim to the email address email@example.com, his data may be used to send commercial information.
The User is responsible for the personal data that he has provided, responding to the accuracy and updating and the damages that could be caused by being incorrect.
Werku will keep and manage the personal data of the User with due confidentiality, applying the necessary computer security measures to prevent access or improper use of said personal data, its manipulation, deterioration or loss. However, the User understands that the security of computer systems is not absolute and that, when personal data is provided over the internet, these may be fraudulently collected by third parties without the consent of the User, which is beyond any responsibility of Werku.
The User may access and exercise these rights by means of a written and signed request, attaching a photocopy of his identity document, by any of the following ways:
1) Sending a letter to Werku Tools SA, Customer Service, Carretera N-VI km 886, Oleiros, La Coruña, Spain
2) Sending an email to firstname.lastname@example.org
These rights will be taken care of by Werku within a period of one month, which may be extended to two months, due to the complexity of the request or if the number of requests received so requires. All this without prejudice to the duty to keep certain data in the legal terms and until the possible responsibilities derived from a possible treatment, or, where appropriate, from a contractual relationship prescribe.
In addition to the aforementioned and in relation to data protection regulations, the User who so requests, has the possibility of organizing the destination of his data after his death.
